Conditionality and Dispositionality
Counterplan Refresher
As per the Intro to Counterplans guide, a counterplan is a negative position that negates the plan through presenting an opportunity cost. Put simply, “the aff is bad because it precludes us from doing something better”.
This derives from the economic theory of opportunity cost, which states that we should value the opportunities that any action forgoes as a cost to that action.
Imagine that it’s 1998, and you want to invest in a tech company. You search the market, but there’s one that piques your interest: Bing.
You go first to invest in Bing. All goes smoothly. You think about investing in another company, but realize you spent most of your money on Bing and wouldn't have enough to buy from another company at starting price.
Over the next 20 years, this relatively early Bing investment makes you several million dollars. In a vacuum, this was a good investment. The answer to the question “Should you have invested in Bing?” is yes.
However, you realize that another company had started up earlier that year—a company named Google. Had you not invested in Bing, you would have had the opportunity to make billions of dollars.
Some economists would say that action, which made you millions, actually cost you, because it prevented you from making billions more.
In debate, we try to apply this principle to policies. Take the resolution, “the possession of nuclear weapons is immoral”. Most agree that this plan mandates disarming nuclear weapons.
The plan may be beneficial in a vacuum. It may prevent impact scenarios like nuclear war between Russia and NATO, conflict in the South China Sea, or India-Pakistan escalation, as, in a world of disarmament, nukes can no longer be fired.
However, doing the plan also prevents us from instituting a global “no first use” treaty. If nuclear weapons don’t exist, there can’t be a global treaty in which every nation promises never to be the first to use nukes in a conflict. This element—the idea that we cannot do both the plan and the counterplan—establishes competition.
The “no first use” counterplan likely solves case; that is, if no country uses nuclear weapons first, they won’t be used at all, which looks identical to disarm.
No first use may also have the independent “net benefit” of bolstering global cooperation between otherwise antagonistic world powers, as it relies on mutual trust. If these premises are true, then the plan is bad because it precludes us from a better course of action: no first use.

Parts of a Counterplan
Text—the thesis statement or “plan” element of a counterplan, e.g.,
“States should publicly declare and abide by a binding nuclear no first use policy, including:
---discussions and negotiations with all relevant states
---operational reductions in nuclear weapons
---bans on similar weapons like landmines and neutron bombs
---prohibiting verbal threats of nuclear first use;
---permitting nuclear use in retaliation to nuclear attacks on allies.”
Texts may include multiple “planks”, which detail different elements of the counterplan’s mandate.
Competition—the warrant for the counterplan being an opportunity cost to the plan, i.e., “we cannot do both”, or “the plan precludes us from doing this”. Counterplans can be textually or functionally competitive.
Textual competition occurs when the counterplan competes with the literal text of the plan. An example of this is a word PIC, where the negative garners competition from a word in the plan they deem problematic: “we endorse the entirety of the aff absent their use of the term “United States Federal Government”. The argument here is not that the counterplan functionally looks any different (which allows the neg to “solve” or steal all of the aff’s ground), but that it competes literally, which is the only textually predictable basis for competition.
Functional competition operates in the world of fiat, where the institution of the plan literally precludes us from instituting the counterplan (or vice versa). The no first use counterplan is functionally competitive, because a policy of no first use of nuclear weapons cannot exist if there are no nukes in the first place.
Net Benefit—why the counterplan is preferable to the plan. Net benefits can look like disadvantages, where the counterplan avoids or solves a mandate of the plan that the negative objects to (“net benefit is the politics DA—that’s [author]”). They can also look like advantages, where an element of the counterplan competitive with the plan is offensively good (“cooperation solves war—that’s [author]”).
Counterplan Answers
The acronym “POSTAL” describes all affirmative answers to the counterplan:
Permutation—a test of competition between the plan and CP, i.e., “we can do both”.
Offense—a link or impact turn to the net benefit.
Solvency (deficits)—a reason the counterplan cannot solve the aff.
Theory—a reason the counterplan is theoretically illegitimate and should be rejected.
Add-ons—offense (usually an addendum to case) that the counterplan can’t solve.
Link arguments—reasons the counterplan does not link to their net benefit.
Counterplan Status
Imagine a world in which the negative reads two disadvantages and two counterplans.
The affirmative stands up in 1NC CX and asks, “what is the status of the counterplans?” What does the negative say?
There are three statuses a counterplan can have: unconditionality, dispositionality, and conditionality.
Example 1: the negative says, “the counterplans are unconditional”.
In a world where the counterplan is unconditional, the neg is stuck with it.
Imagine the aff impact turns the net benefit to the counterplan in the 1AR. The negative cannot get up in the 2NR and say “the counterplan may be bad; however, we have won the disadvantage, proving the plan bad, which is sufficient for a negative ballot”.
If the counterplan is unconditional, the negative is stuck in the world of the counterplan—i.e., they cannot kick the counterplan, nor any planks.
Example 2: the negative says, “the counterplans are dispositional”.
There are two worlds of dispositionality.
World A: the affirmative does not read theory or permutation arguments against the counterplan.
In this world, the affirmative could read link or impact defense to the net benefit, uniqueness arguments, and/or link/impact turns. As long as they do not read a theory or permutation argument against the counterplan, the negative is stuck with it. This makes the counterplan effectively unconditional.
World B: the affirmative reads theory or permutations against the counterplan.
If the aff reads a theoretical objection to the counterplan (e.g. private actor fiat, PICs bad, floating PICs bad, international fiat, multi-actor fiat, etc.) and/or a permutation argument, the negative is allowed to kick the CP.
In a world where the negative is losing to “floating PICs bad”, for example, they can choose to say “we’re kicking the counterplan—the disadvantage is sufficient to negate”. Similarly, if the 1AR says, “perm do both—that’s [author] for [x warrant]”, the negative can concede the permutation and go for something else.
The two worlds of dispositionality are fairly intuitive—if the aff makes arguments that the counterplan is theoretically illegitimate and skews the round/voids clash, or that it’s not competitive, the negative should be allowed to agree, and kick the argument. Otherwise, they should be held to their advocacy.
Example 3: the negative says, “the counterplans are conditional”.
In a world of conditionality, the negative can always kick the counterplan. This allows them to read multiple advocacies without worrying about contradiction, and go for as many or as few as they want in the 2NR, including kicking all of them and going for the status quo (i.e. a disadvantage).
Aff Arguments
There are many theoretical warrants for why conditionality is a voting issue.
Time skew
Counterplans create unique time pressure on the already short 1AR, which now has to make uniqueness, permutation, theory, link, and impact arguments. In a world of conditionality, not only does this waste 1AR time, it moots it.
Defense to disads is valuable because it can be cross-applied in the 2AR even if the negative doesn’t go for it. Similarly, offense on the disadvantage must be answered or kicked out of by conceding uniqueness or link defense. This is true because all disads operate in the same world: the status quo.
However, if the negative can kick counterplans that all operate in unique worlds of neg fiat, the aff cannot cross-apply defensive or offensive arguments in the 2AR. At the very least, the ease and strategic value of doing so is greatly diminished.
Put simply, conditionality creates a world in which significant 1AR time has zero strategic value and the aff has no recourse.
Strat Skew
In a world of conditionality, the ability for the neg to kick counterplans with no repercussion allows them to read contradictory advocacies.
For example, the negative could read in the 1NC a kritik of capitalism, and a counterplan which advocates for a laissez-faire, free-market approach to economics.
In this example, it is nearly impossible for the aff to respond. Making responses on one flow almost inevitably hurts them on the other. Unrestrained conditionality creates an incentive structure that makes these situations inevitable.
Argument Irresponsibility
There is no reciprocal strategic cost to reading counterplans in a world of unrestrained conditionality. Whatever the 1AR response, whether it be an impact turn, a theory argument, a perm, link turns to the net benefit, etc., you can always kick the counterplan.
The impact is the scourge of policy arguments: backfile process counterplans with outdated politics cards, uniqueness counterplanning out of your own disads, counterplans with 10 planks and no solvency advocate, etc. This voids topic education and makes debate a race to the bottom for worse and worse research practices.
Tips for Going for Condo
1] Dispo solves a majority of neg offense. The aff should always explain why the benefits to conditionality the neg articulates are the same in a world of dispositionality, but the costs (as per the 1AR) are avoided.
The warrant for this is usually simply that perms and theory are read in almost every 1AR that answers the counterplan. They are hugely strategically valuable. The affirmative argues that the only circumstance where the 1AR would choose to void these options is if the counterplan was abusive, irresponsible, or contradictory.
2] The most strategic standard to go for in the 2AR is strat skew. Defense, which is below, likely solves every other standard.
3] Condo is a no-risk option for the aff. While it is a position that, equally debated, likely flows negative, the affirmative can be losing every other element of the round and win on condo if the 2NR mishandles it.
This means that, while condo is often not the most strategic 2AR, it is a very strategic argument to have (briefly) in the 1AR, because the 2NR has to spend a lot of time on it or risk losing the entire round.
Neg Arguments
It’s 2026—don’t lose to conditionality.
Neg Flex
The first thing that the negative wants to do is establish uniqueness for the round. Debate is inherently aff-skewed—the aff gets infinite prep, gets to speak first and last, and sets the burden of rejoinder for the round. Conditionality is the god-given right of the negative to equalize this imbalance.
In a world of unconditionality, going for counterplan arguments obviates case/disad positions, and vice versa. This disincentivizes diverse topic prep and research and rids the negative of key strategic flexibility that is necessary to overcome the fundamental aff advantage. The resulting model is irresolvably skewed, systemically unfair, and takes the debate out of the hands of the debaters.
Logic/Negation Theory
“If it competes, it’s legit”. The burden of the negative is to prove the resolution false. They can do this, either with disadvantages, which prove that the status quo is preferable to the plan, or counterplans, which prove an opportunity cost to the plan.
This means that, logically, the negative should be able to go for either—the aff proving the counterplan bad doesn’t affirm, and the status quo should always be an option for the negative. Negation theory is important because it’s the only thing textually intrinsic and predictable to the round.
Risk Aversion
Under a model of unconditionality, debaters won’t cut all but a handful of counterplans because they know they may be forced to go for it. This voids creative approaches to the topic and aff testing, and sacrifices swaths of unique counterplan debates for a handful of stock issues.
Defense
Like before, the aff has infinite prep pre-round to set the burden of rejoinder. Insofar as this is true, they have infinite time to cut uniqueness arguments about why certainty, immediacy, their actor, or their process are key.
Not only this, but they had the opportunity to choose an actor, process, or method of doing the plan. These uniqueness arguments that they chose and had infinite time to prep are solvency deficits to every competitive counterplan, and are incredibly easy to cross-apply in the 1AR.
This has two implications. First, arguments like time skew are zeroed, because the affirmative can answer bad counterplans far more efficiently than the negative can read them, even taking into consideration 1AR time pressure.
Second, it proves there is a reciprocal strategic cost to reading bad counterplans. Bad counterplans will be easily taken out in the 1AR, and will waste neg time instead of aff time. This is the homeostasis of debate—bad arguments are crowded out, not due to some arbitrary affirmative brightline, but because they lose.
Tips for Answering Condo
1] If the affirmative doesn’t ask the status of the counterplan in 1NC CX, you’re now able to say “No link—the counterplans are dispositional. They have read theory arguments against them, which gives us license to kick”.
2] The concept of “reasonability” is often very effective in answering condo. The idea is that the affirmative doesn’t get to win in a world where their model presents a slight net benefit. This would lead to debates being decided over theory shells like “the affirmative must shake hands with the negative before the round.”
If the negative can prove their model “reasonably” sustains debate, that should be sufficient to answer the shell—otherwise “substance crowd-out” occurs, where policy debates are voided in favor of infinite, frivolous theory shells. This lack of education and obvious unpredictability and unfairness certainly outweighs any offense on condo.
This model doesn’t void theory shells entirely—rather, the affirmative must prove that the abuse either outweighs substance crowd-out (in the case of, for example, in-round racism or discrimination), or that their shell doesn’t lead to substance crowd-out because it is in some way textually predictable (i.e., topicality arguments don’t lead to substance crowd-out because they regard the text of the resolution, which everyone has equal access to, so they can be prepared for and aren’t spammed to void opponent prep).
3] Theory rounds often come down to a predictability v. debatability/limits push. Both are strong ground for the negative in condo rounds: “neg flex” is an example of a debateability argument, while “logic” is an example of a predictability focused standard. However, the aff has very little predictability ground and often far more debatability arguments. Either way, a huge number of theory rounds come down to weighing between these two principles.
The predictability team wants to say that predictability is a gateway issue, a necessary internal link to access any of the aff’s impacts. Clash and fairness are important, and they can’t happen without equal, rigorous prep, which means predictability comes first.
The debatability team wants to say that arguments like “constitutiveness”, and "textuality" are tautological, and the only real impacts are fairness and clash. Predictability doesn’t outweigh, because it doesn’t matter if the aff gets predictably screwed, or arguments are predictably slop. Rounds have to be debatable for anything else to matter; that comes first. Predictability’s also unverifiable and non-unique—everyone has different perceptions and predictions about the resolution and the round, as well as vastly different teams, coaches, and prep opportunities.
Judge Kick
Imagine the negative goes for a disad and a counterplan in the 2NR. The affirmative gets up in the 2AR and extends a 1AR impact turn to the net benefit that was dropped. At the end of the debate, it is clear that the disad outweighs case—the impact turn, however, outweighs both. How should the judge vote?
If we assume the neg exists in the world of the counterplan, they should vote aff. However, the judge may kick the counterplan and vote on the disad as a logical result of negation theory (above).
Most judges think this line of reasoning needs to be flagged by the neg in the 2NR for it to be voted on. However, some judges will say “auto-judge kick” or “judge kick by default” in their paradigm, which tells you that if the neg is losing on an advocacy they’ve fiatted, they may vote on the status quo. Otherwise, you should assume you have to flag this argument.
Kritiks
It is important to mention that a fiatted alternative to a kritik (e.g. “the alt is party socialism”) functions as a counterplan, because it is an instance in which the neg has used fiat (i.e. they have proposed an action and weighed the relative costs/benefits of that action against the plan).
This means that a kritik alternative can also be unconditional, dispositional, or conditional.
Judge Adaptation
These rounds heavily depend on the judge. A condo round in front of a judge that says “I believe unrestrained conditionality is ruining debate” in their paradigm is very different from a round in front of a judge that says “I believe condo is the negative’s god-given right”.
For example, the former judge might be happy to vote for a 1AR shell that says “Condo is a voter”, whereas “The negative gets two condo advocacies” might be more strategic in front of the latter.
Both teams should ideally be making arguments or using phrases from the judge’s paradigm. A negative debater that sees “condo 2ARs in LD are too new”, might read “no 1AR theory”, or give a 2NR argument to the effect of “they have two words on strat skew and no warrant; if this is their 2AR it will be brand new because it was not a complete argument in the 1AR and we never got to respond”.
Ethos
These debates often come down to explanatory power and examples.
It is usually true that whoever can most effectively explain what the world of their interp looks like—what debates occur/are incentivized, why the world of your interp is so much more interesting, balanced, and educational than your opponent’s world (which is overrun with hopelessly skewed, slop rounds that make debate useless)—will win.
It is often strategic to try to make the first or last few seconds on condo very ethos-y. Examples are key. Judges were debaters once—explain why arguments they love happen under your model, and arguments they hate are incentivized under your opponents’.
